“MASTERCARD MEET THE TEAM T20 2019” PROMOTION

TERMS AND CONDITIONS

  1. The Promoter is Mastercard Asia Pacific (Australia) Pty Ltd ABN 95 108 603 345 of 72 Christie Street, St Leonards, NSW 2065.
  2. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  3. Entry is only open to any person aged 16 or older who holds a valid Mastercard. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor submitting a claim in this promotion.
  4. Employees (and their immediate families) of the Promoter, participating outlets and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. The Promotion will be conducted at participating T20 matches (“Matches”) conducted between 27/10/2019 and 08/11/2019 inclusive, as detailed in Annexure A below (“Promotional Period”). Entries at each Match will be open one (1) hour before the first ball of the Match until three (3) hours after the first ball of the Match (i.e. four (4) hours in total).
  6. A representative of the Promoter will conduct a draw prior to the Promotional Period to determine two (2) winning times using a random selection system. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 10am AEDST on 11/10/2019. For the avoidance of doubt, there are two (2) instant win prizes available to be won and for each prize, the system will randomly select a Match, a merchandise outlet located at the stadium where the Match is being played and a winning time for that prize (“Winning Time”).
  7. To participate in the promotion, individuals who are attending a Match during the Promotional Period must use their Mastercard as payment tender for a transaction at any participating merchandise outlet located at the stadium of the Match (“Qualifying Transaction”). Participating outlets are any outlets located at the stadium of the Matches that display material advertising this Promotion.
  8. The first eligible entrant who makes a Qualifying Transaction at a Winning Time at the participating merchandise outlet at the Match associated with that Winning Time (or if no entrant makes a Qualifying Transaction at a Winning Time, the first entrant that makes a Qualifying Transaction after the Winning Time) will win an instant prize. Each winner will be subject to eligibility and entry requirements as notified by the promotional staff.
  9. Each winner will be notified immediately, by promotional staff, once they complete the winning Qualifying Transaction. The promotional staff will notify the winner that they have won and what prize they have won. Winners are required to confirm acceptance immediately upon notification by promotional staff. Failure to do this will result in the prize being forfeited and the Promoter may at its absolute discretion select another winner (who will be the next valid entrant to make a Qualifying Transaction). The decision of the Promoter is final and no correspondence will be entered into.
  10. Winners will be required to provide their name, telephone number, email address and postal address through a prize acknowledgement form in order to accept a prize. Winners will be published in The Australian on 28/11/2019.
  11. The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  13. There are two (2) instant prizes available to be won across all Matches. Each prize is a ‘Meet the Australian Men’s Cricket Team’ experience for two (2) people valued at up to $5,000 depending on point of departure. Prizes includes:
    • Two (2) x return economy airfares from winner's nearest capital city to Sydney, NSW (if required);
    • One (1) night twin share four-star accommodation;
    • Two (2) match tickets to Australia v New Zealand at Sydney Cricket Ground on 15/03/2020;
    • The opportunity to meet and greet selected members of the Australian Men’s Cricket Team;
    • A behind the scenes tour of Sydney Cricket Ground; and
    • A Cricket Australia merchandise pack.

    Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the Australia v New Zealand ODI match on 15/03/2020 and is subject to booking and flight availability. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Winners may be required to present their credit card at time of accommodation check in. Winners and their companion must depart from and return to the same departure point and travel together. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.

  14. If a winner resides within NSW, the Promoter will liaise with the winner to determine whether or not the prize includes airfares. In the event the prize does not include airfares, then the airfare component of the prize will be forfeited and will not be redeemable for cash.
  15. If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
  16. If a prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  17. The “Meet & Greet” awarded as part of each prize provides the winners (and their companions with an opportunity to meet one (1) or more members of the Australian Men’s Cricket Team. This element of the prize is not guaranteed and is subject to the goodwill of the team members on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the prize cannot be offered for any reason.
  18. Total prize pool value is up to $10,000.
  19. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  20. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
  21. Entrants consent to the Promoter and Cricket Australia using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Cricket Australia (ABN 95 108 603 345) (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a Match, or the appearance of any or all of the Australian Men’s Cricket team is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter or Cricket Australia; (f) any tax liability incurred by a winner or entrant; or (g) taking of or participation in a prize.
  25. Cricket Australia reserves the right in its absolute discretion to change or amend the cricket fixture without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any cricket match connected with this Promotion for any reason beyond the control of the Promoter or Cricket Australia.
  26. By entering this promotion entrants agree to comply, and ensure that each subsequent ticket holder complies, with the ticket conditions which accompany any tickets won in conjunction with the promotion. Entrants also agree to comply, and ensure that each subsequent ticket holder complies, with Cricket Australia’s Ticket and Entry Conditions (available at ww.cricket.com.au/tickets) supplemented by conditions of entry imposed by the venue operator. The Promoter will provide every person attending the match as part of the promotion with a copy of Cricket Australia’s Ticket and Entry Conditions with delivery of the prize tickets.
  27. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, gift suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.mastercard.com.au/en-au/about-mastercard/what-we-do/privacy.html. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose claimant’s personal information to any entity outside of Australia.
